Third horse dies on set of HBO's 'Luck'

There seems to be no "Luck" on this set.

HBO's racetrack drama suffered the death of two horses, one in 2010 and one in 2011, and today we learn that a third horse has died.

"Tragically, this morning, one of the horses in Lucks stable suffered an accident while returning to the stall," the network told E! News in a statement.

The HBO statement continues, "California Horse Racing Board (CHRB) official veterinarian Dr. Gary Beck stated, 'I had just examined the horse as part of our routine health and safety procedures prior to work that would be done later on the track. The horse was on her way back to the stall when she reared, flipped over backwards, and struck her head on the ground. Fortunately, attending veterinarian Dr. Heidi Agnic was there to administer immediate aid to the injured horse and determined that humane euthanasia was appropriate.'

"CHRB Equine Medical Director Dr. Rick Arthur said, 'As with all fatalities within CHRB racing enclosures a necropsy will be conducted. Unfortunately, we see several of these injuries in the stable area every year. They are more common than people realize.'

"An American Humane Association Certified Safety Representative was on the premises when the accident occurred, and all safety precautions were in place," adds the network's statement. "HBO and everyone involved with the production are deeply saddened, and are working in full cooperation with the AHA and the CHRB to complete their inquiry."

A spokesperson for PETA expressed concerns with the ongoing tragedies, telling E! News after the first two deaths, "Horses don't break down without a reason of breaking down. And so we want to know...we want to know, first of all, who were the horses. They were allegedly former race horses; we want to know their names.

"We can look at their racing records, we'd like to see the necropsy reports, because we'd like to know what was found. We have some serious concerns with the way that they were filming by running the horses and then resting them and running them again. Because you know, for a horse, a horse doesn't know he's acting. For a horse, it's I'm running, I'm stopping, I'm running, I'm stopping. And even if it's done only three times, which doesn't seem like very much to us, that's a lot for a thoroughbred.

"That's a lot of running in a single day for a horse who is a trained racing horse. They just don't do that. And so we have some really serious concerns about that. But we haven't received any more information about it yet."

Credit quest software and the Nigerian financial clients ...

It is encouraging seeing most Nigerian banks now using Credit Quest Software in analysing credit clients. This is a necessary and vital step forward in the pursuit of financial standards in line with the practices in other developed worlds.

However, there is still a major concern which I fear will undermine credit management issues and will scuttle or derail any progress made in this sector of our economy. I am afraid that the standard of the rating modeling administration adopted by the banks in assessing credit applications is not entirely convincing. Considering the level of the sophistication of the Nigerian economy, there remains the concern that the Credit Quest Software used by the banks may not exactly be reliable.

Financial computing which provides the basis for the development of most credit software applications takes cognisance of various environmental issues, ranging from key business and regulatory issues to providing input to public policy on financial services.

The software functions and its capabilities to capture the Nigerian economic volatility through the use of Computational Finance and Financial IT are in doubts. Both Computational Finance which deals with issues such as risk management, algorithmic trading, market simulation, portfolio optimisation, etc., and Financial IT which covers scalable high performance computing, financial software engineering, graphic processing unit (GPU) also known as visual processing unit (VPU), and cloud computing relies on efficient market information and effective data collation among others.

Nigeria has no adequate market information channels and no reliable data collation especially as related to organised pattern of financial behaviour of individuals and corporations. This makes the accuracy of the analytical results of financial clients obtained by the current credit software precariously unreliable.

In using information obtained on the evidence of the result from the credit software, the banks should also adopt caution. The system is still very much in its infancy and personal knowledge of each credit applicant should not be discountenanced while we continue with the development of credit software which can improve the banking and credit efficiency.

The system can only be effective when other sectors of our economy are also developed. There must be a functional regulatory system for the financial sector, the judiciary and law enforcement agencies. The standard and method of information sharing must be improved by empowering the agencies responsible for data collation ? offices of statistics and information ministries. We must understand the country?s demography in relation to change patterns.

Financial modeling is all involving. The current Credit Quest Software and any other credit software used by the banks are not robust enough to capture vital trends that pivot the building of credit client?s image needed to make a critical credit decision. Most clients? images as represented presently by the credit software may not accurately march their portfolio.

Despite the obvious imperfections which may have been observed that dogs the pioneering of the use of credit software in making credit decisions by the banks, the Nigerian banks are better positioned for business and this will benefit the economy. The use of the credit software is a step in the right direction but there is need for continual development and evolvement.

Microsoft cuts touchscreen lag to 1ms, makes other panels look silly (video)

Have you ever noticed that there is a serious amount of lag between when you move your finger on a touchscreen and when it actually registers that input? Perhaps you haven't, but most panels and controllers out there suffer from about a 100ms delay. For taps and slow swipes that's not an issue but, as you wing your finger around the screen faster and faster (say, while quickly doodling in a painting app), the lag becomes quite apparent. The powerful minds over at Microsoft Research have figured out a way to get that delay down to a measly 1ms. Of course, there's no guarantee this tech will ever make it into a product, and the video after the break shows little more than a glowing box following a finger. Still, it's always enjoyable to see where we are now versus where we could be.

SALT LAKE CITY (AP) ? The operator of a Utah coal mine where a 2007 collapse led to the deaths of nine people agreed on Friday to plead guilty to two misdemeanor criminal charges and pay a $500,000 fine.

Six miners died at Crandall Canyon in central Utah in the August 2007 collapse so powerful that it initially registered as a 3.9-magnitude earthquake. Another cave-in 10 days later killed two rescuers and a federal inspector. The operation was eventually called off after drilling into the mountain found no sign of the trapped men. Their bodies remain deep in the mine's catacombs.

In documents filed in federal court in Salt Lake City Friday, attorneys for Genwal Resources Inc. noted that while it agreed to plead guilty to two counts of violating mandatory health and safety standards and pay the fine, the company can withdraw the agreement should the court not accept the plea.

The company still maintains it's mine was safe but said the plea agreement "avoids Genwal putting its former employees, their families, and members of the community at large through the ordeal of reliving the tragic events," according to a statement Friday from company lawyers.

"Significantly, the agreement reflects the lack of evidence that any conduct by the company caused the accidents," the statement said.

Genwal, based in Pepper Pike, Ohio, is an affiliate of Murray Energy Corp.

U.S. Attorney David B. Barlow said the charges support their case. According to the two counts filed Friday, Genwal "willfully violated a mandatory health and safety standard" by failing to report the initial accident to federal authorities within 15 minutes. The second charges the company violated approved roof control plans.

"These are the charges that we felt we could prove beyond a reasonable doubt," Barlow said.

Relatives of the victims only heard about the charges Friday morning, and were surprised because they had previously been told there wouldn't be any charges filed, said Alan Mortensen, an attorney representing eight of the families.

While there were mixed reactions, Mortensen said Genwal's guilty plea brings some closure.

"It put Genwal in a position where they had to admit there were willful violations," Mortensen said.

However, he added, the company's steadfast denial of fault "shows a continuing pattern of them not taking responsibility. It's very arrogant and unapologetic."

The company and its insurers had previously settled with family members of the dead miners or rescuers, but the terms of that agreement were never disclosed publicly. Lawyers on both sides have said it exceeded the more than $20 million paid to families of 27 victims of a 1984 fire at the closed Wilberg mine in the same Utah coal district.

The method of mining used at the Genwal site where the deadly collapse occurred has a history of being disproportionately deadly, according to federal safety studies.

The Crandall Canyon mine collapse happened while miners were engaged in a method called "retreat mining," in which pillars of coal are used to hold up an area of the mine's roof. When that area is completely mined, the company pulls the pillar and grabs the useful coal, causing an intentional collapse.

Tony Oppegard, a former top federal and state of Kentucky mine safety official who is now a private attorney in Lexington, Ky., has called the technique "the most dangerous type of mining there is."

According to the American Society of Safety Engineers, retreat mining requires very precise planning and sequencing to ensure roof stability while the pillars supporting the roof are removed.

The reason the practice is used is that it pays off: The last bit of coal taken from pillars is pure profit, Oppegard said. Plus, if someone violates rules during pillar removal and there is a collapse, the evidence of rule violations are gone, he added.

Retreat pillar mining is one of the biggest causes of mine roof collapse deaths, according to studies done by the National Institutes of Occupational Safety and Health.

"We recognize that nothing we can do will ever bring back the miners who perished, restore the health of those who were injured during the rescue, or erase the nightmares that still haunt those who were firsthand witnesses to these tragedies," Barlow said. "It is this office's intent that these charges send the message to mining companies everywhere: obey the safety laws."

Mapping the Moho with GOCE

ScienceDaily (Mar. 9, 2012) ? The first global high-resolution map of the boundary between Earth's crust and mantle -- the Moho -- has been produced based on data from ESA's GOCE gravity satellite. Understanding the Moho will offer new clues into the dynamics of Earth's interior.

Earth's crust is the outermost solid shell of our planet. Even though it makes up less than 1% of the volume of the planet, the crust is exceptionally important not just because we live on it, but because is the place where all our geological resources like natural gas, oil and minerals come from.

The crust and upper mantle is also the place where most geological processes of great importance occur, such as earthquakes, volcanism and orogeny.

Until just a century ago, we didn't know Earth has a crust. In 1909, Croatian seismologist Andrija Mohorovi?i? found that at about 50 km underground there is a sudden change in seismic speed.

Ever since, that boundary between Earth's crust and underlying mantle has been known as the Mohorovi?i? discontinuity, or Moho.

Even today, almost all we know about Earth's deep layers comes from two methods: seismic and gravimetric.

Seismic methods are based on observing changes in the propagation velocity of seismic waves between the crust and mantle.

Gravimetry looks at the gravitational effect due to the density difference caused by the changing composition of crust and mantle.

But the Moho models based on seismic or gravity data are usually limited by poor data coverage or data being only available along single profiles.

The GOCE Exploitation for Moho Modelling and Applications project -- or GEMMA -- has now generated the first global high-resolution map of the boundary between Earth's crust and mantle based on data from the GOCE satellite.

GOCE measures the gravity field and models the geoid with unprecedented accuracy to advance our knowledge of ocean circulation, which plays a crucial role in energy exchanges around the globe, sea-level change and Earth interior processes.

GEMMA's Moho map is based on the inversion of homogenous well-distributed gravimetric data.

For the first time, it is possible to estimate the Moho depth worldwide with unprecedented resolution, as well as in areas where ground data are not available. This will offer new clues for understanding the dynamics of Earth's interior, unmasking the gravitational signal produced by unknown and irregular subsurface density distribution.

GEMMA is being carried out by Italian scientist Daniele Sampietro, and is funded by the Politecnico di Milano and ESA's Support To Science Element under the Changing Earth Science Network initiative.

This initiative supports young scientists at post-doctoral level in ESA Member States to advance our knowledge in Earth system science by exploiting the observational capacity of ESA missions.

'Holland's Next Top Model' wins agency lawsuit

AMSTERDAM (AP) ? A former model who won the television show "Holland's Next Top Model" has won a lawsuit against the Elite agency after she was dropped for having hips that were supposedly too large.

The Amsterdam District Court has ruled that Ananda Marchildon, now 25, was entitled to the main prize she won in the 2008 production of the show, a contract worth euro75,000 ($98,500). Marchildon argued she was dismissed after only euro10,000 ($13,000) worth of work.

The court said in a written ruling Wednesday that Marchildon had a hip size of 92 centimeters (around 36 inches) at the time of her contract.

The ruling says "Elite could therefore not demand she reach a hip size of 90 centimeters" ? about 35.4 inches.

It awarded her around euro65,000 ($85,000) in damages.

UK Internet providers lose copyright court battle

LONDON (AP) ? The High Court has endorsed Britain's new copyright rules, siding with the music industry over Internet providers in a battle over online filesharing.

The Digital Economy Act ? similar to rules already in place in France and Ireland ? forces Internet service providers to send an escalating series of warnings to users suspected of illegally swapping movies and music. Eventually, service providers can suspend repeat offenders' access to the Web.

The controversy over the British rules has mirrored debates over online copyright enforcement in the United States and elsewhere. Film studios, record labels and other creative groups argue that the rules are needed to stanch the flow of illegal content flooding the Internet; while service providers and civil liberties groups fear that the regime will choke off free expression.

Leading Internet companies BT Group PLC and the TalkTalk Telecom Group PLC took their case to court, arguing that the act would be unnecessarily expensive and invade users' privacy. A lower court rebuffed BT and TalkTalk, and on Tuesday a three-judge panel at London's Court of Appeal endorsed the earlier judgment, to the delight of entertainment lobbying groups.

"Once again the court is on the side of the almost two million workers in the creative industries whose livelihoods are put at risk because creative content is stolen on a daily basis," said Christine Payne, who leads actors' union Equity.

David Puttnam, the president of the Film Distributors' Association, said he hoped the judgment would bring an end to "a long chapter of uncertainty," saying he hoped the Digital Economy Act could help alert consumers, particularly young people, to "the damage piracy inflicts on the whole of the creative community."
